It is also important that the company hires a trustee and an appraiser that understands ESOPs." e ESOP is federally regulated, and as such, comes under scrutiny by the Department of Labor, which performs frequent and periodic audits of ESOPs to make sure they follow the rules and guidelines as defined by the Employee Retirement Income Security Act of 1974 (ERISA).
